Beth's Cafe - Terms and Conditions

Welcome to Beth's Cafe, operated by Beth's Cafe LLC ("Beth's," "we," "us," or "our") at 7311 Aurora Ave N, Seattle, WA 98103. These Terms and Conditions ("Terms") govern your use of our website (bethscafe.com), our SMS text reply service, and your visit to our cafe. By visiting our website, calling our business line, texting with us, dining at our restaurant, or otherwise interacting with Beth's, you agree to these Terms.

Acceptance of Terms

By using our services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use our website, text service, or visit the cafe.

Eligibility

Our website and SMS service are intended for users 13 years of age or older. Beth's Cafe is a family-friendly, all-ages restaurant - guests of any age are welcome to dine with us.

Use of the Website

You may use bethscafe.com for personal, non-commercial purposes only. You agree not to:

  • Use the website in any unlawful manner or for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the site or its servers
  • Reproduce, copy, or resell content from the website without our written permission
  • Scrape, harvest, or systematically collect data from the site
  • Interfere with or disrupt the website's operation

Visiting the Cafe

Beth's Cafe is a community-focused, family-friendly diner. By visiting, you agree to treat staff and other guests with respect. Harassment, discrimination, threats, and violence are not tolerated and will result in immediate removal and may be reported to law enforcement.

We reserve the right to refuse service or entry, with or without cause, in accordance with applicable law. Common reasons we may refuse service include disruptive behavior, harassment of others, or violation of these Terms.

You enter and use the cafe at your own risk. While we take reasonable steps to maintain a safe environment, we are not responsible for personal belongings left on the premises.

SMS Text Communications

When you call Beth's at 206-782-5588 and the call is unanswered, you may receive an automated text message from us in response. By voluntarily calling our publicly published phone number, you provide implied consent to receive a direct SMS reply at the same phone number.

Our text replies are customer service in nature and provide information you have asked for or are likely to find useful (hours, menu, parking, wait times, reservation handling, catering inquiries, etc.). We do not send promotional or marketing SMS under this service.

Message frequency varies based on conversation but is typically 1-10 messages per interaction. Standard message and data rates from your mobile carrier may apply. We send messages through a third-party SMS service provider that processes message contents solely for delivery purposes.

To opt out at any time, reply STOP, UNSUBSCRIBE, END, QUIT, or CANCEL to any message we send. You will receive a single opt-out confirmation message and will not receive further SMS from us. You may also opt out by emailing mason@bethscafe.com with the subject line "SMS Opt-Out." To opt back in, simply call our business number again.

We are not liable for delayed, undelivered, or misdirected SMS messages due to mobile carrier outages, recipient device issues, or other factors outside our control.

Reservations

Beth's accepts reservations for parties of 6 or more guests. Smaller groups are seated on a walk-in basis. Reservation requests are confirmed by Beth's only after we follow up directly with you. Please be on time - if your group is more than 15 minutes late, we may release the table to walk-in guests.

Online Orders

Online food orders are fulfilled through our partner Popmenu (bethscafe.com/popmenu-order). Your use of this service is also subject to the terms of Popmenu. Orders are subject to availability and may occasionally be modified or canceled if items are unavailable - we will contact you to arrange a refund or substitution if that happens.

Gift Cards

Gift cards may be purchased in person at the cafe or digitally through Toast at toasttab.com/beths-cafe-7311-aurora-ave-n/giftcards. Digital gift card purchases are subject to Toast's terms in addition to ours. Gift cards do not expire and are non-refundable for cash unless required by law.

Catering and Private Events

Catering and private event bookings are arranged by direct outreach to mason@bethscafe.com. All bookings are subject to a separate written agreement specifying scope, deposit, cancellation terms, headcount, menu, and other details.

A 50% deposit is required to confirm an event date. Full refund is available if cancellation occurs more than 14 days before the event. Cancellations within 14 days of the event forfeit the deposit; we will work out remaining details case by case.

Intellectual Property

All content on bethscafe.com - including text, images, logos, menu names, design elements, and photos - is the property of Beth's Cafe LLC or its licensors and is protected by copyright and trademark law. You may not use, reproduce, or distribute any content from our website without our prior written permission, except for personal, non-commercial use such as sharing a menu link on social media.

The names "Beth's Cafe" and "Beth's" are trademarks of Beth's Cafe LLC.

Wall of Fame Customer Artwork

Beth's invites customers to contribute artwork to our Wall of Fame, a long-standing tradition since 1954. By contributing artwork to display at Beth's, you grant Beth's Cafe LLC a non-exclusive, perpetual, royalty-free license to display, photograph, and reproduce the artwork on our premises, in our marketing materials, on our website, and on our social media. Original artwork remains your property; Beth's may retain or rotate displayed pieces at our discretion. Inappropriate, hateful, or commercially branded submissions will not be displayed.

Photography and Recording

Photographs and audio/video recordings are routinely taken at Beth's for documentation, promotion, and social media. By entering the cafe, you consent to being photographed or recorded in public areas of the property. If you do not wish to be photographed, please notify our staff and we will make reasonable accommodations.

Limitation of Liability

To the maximum extent permitted by law, Beth's Cafe LLC, its owners, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website, SMS service, or visit to the cafe. Our total liability for any claim shall not exceed the amount you paid to Beth's (if any) in connection with the matter giving rise to the claim.

Some jurisdictions do not allow exclusion or limitation of certain damages, so portions of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Beth's Cafe LLC, its owners, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising out of your violation of these Terms or your misuse of our website, SMS service, or cafe.

Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of our services shall be resolved in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. The "Effective Date" at the top will be revised when changes are made. Material changes will be reflected on this page. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms.

Severability

If any portion of these Terms is found to be unenforceable, the remaining portions will remain in full force and effect.
